Terms of Service

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

Generating videos requires a signed-in account. Sign-in is by passwordless magic link sent to your email — there is no password to remember. You are responsible for maintaining the security of your email account and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use.

The Service runs on prepaid credits. You purchase credit packs through our payment processor, Stripe, and credits are consumed when you generate output. Current pack tiers and prices are shown on the pricing page and may change over time. Any change to pack prices applies only to purchases made after the change takes effect; the price shown at the time of purchase governs that purchase. Prepaid credits do not expire while your account remains active.

Credits are a pass-through mechanism that funds the underlying generation cost. Accordingly:

• Completed generations are charged. Once a generation completes and output is delivered, the credits for that job are consumed and are non-refundable — including where you are unhappy with the result. AI output is inherently variable; a delivered clip you dislike is not a defect.
• Failed or blocked generations are not charged. If a generation fails for a technical reason, or is blocked by content moderation (see Section 4), the credits for that job are not consumed (or are returned to your balance).
• Credits have no cash value, are non-transferable, and are not redeemable for money except where required by law.

Except as expressly stated here or required by applicable law, all purchases are final and non-refundable. Payment-card details are handled entirely by Stripe; we do not store your full card number.

You agree not to use the Service to create, upload, or distribute content that is unlawful, infringing, or harmful. In particular, you must not:

• Upload, or attempt to recreate, material you do not have the rights to use — including copyrighted footage or images, trademarked brands or logos, or recognizable characters or IP you do not own or license.
• Generate content that is illegal, defamatory, or that infringes the intellectual-property, privacy, or publicity rights of any person.
• Generate sexual content involving minors, non-consensual sexual content, or content that promotes violence, hatred, or unlawful acts.
• Attempt to circumvent content moderation, usage limits, security controls, or these Terms, or use the Service to build a competing model or dataset.

You are solely responsible for the inputs you provide.

Generation is performed by a third-party AI generation provider. That provider applies its own content moderation and may block or refuse to return output it deems unsafe or policy-violating, in whole or in part. We do not control these moderation decisions.

A generation that is blocked by moderation results in no charge (see Section 2). We may also review, restrict, suspend, or terminate access for content that violates Section 3, and repeated or serious abuse may result in account suspension or termination without refund of any consumed credits.

You retain ownership of the footage, images, audio, and prompts you upload (“Input Content”). You represent that you have all rights necessary to upload that Input Content and to have it processed by the Service.

You grant vfxmagia a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and create derivative works from your Input Content solely to operate, provide, secure, and support the Service — including transmitting it to the processors named in our Privacy Policy. This license ends when the content is deleted under our retention schedule, except for residual copies in routine backups and to the extent we must retain it to comply with law.

Subject to your compliance with these Terms (including Section 3) and payment of the applicable credits, vfxmagia assigns to you all rights it may hold in the video output generated for you, to the fullest extent such rights are assignable under applicable law. You may use that output for personal or commercial purposes.

You acknowledge that (a) the legal status and copyrightability of AI-generated material is uncertain and varies by jurisdiction, (b) similar output may be generated for other users from different inputs, and (c) we make no representation that output is free of third-party rights — that depends on the inputs and prompts you provide.

We respect intellectual-property rights and will respond to valid notices of claimed infringement. If you believe content on the Service infringes a copyright, trademark, or other right you hold, send a written notice to contact@vfxmagia.com that includes:

• identification of the work or right claimed to be infringed;
• identification of the allegedly infringing material and enough detail for us to locate it (such as the relevant URL, job, or account);
• your name, address, email, and other contact information;
• a statement that you have a good-faith belief the use is not authorized by the rightsholder, its agent, or the law;
• a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rightsholder or authorized to act on the rightsholder’s behalf, together with your physical or electronic signature.

We may remove or disable access to allegedly infringing material and, consistent with our takedown rights in Section 4, may terminate the accounts of repeat infringers. Knowingly submitting a materially false notice may expose you to liability.

The Service relies on third-party processors to function — including a third-party AI generation provider (AI generation and moderation), Cloudflare R2 (media storage), and Stripe (payments). Your use of the Service is also subject to those providers’ terms, and we are not responsible for their acts or omissions. See the Privacy Policy for how data is shared with them.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, that defects will be corrected, or that any particular output will meet your expectations, be accurate, or be suitable for any purpose. AI output is probabilistic and may contain errors or artifacts.

To the maximum extent permitted by law, vfxmagia and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Service.

Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the three (3) months before the event giving rise to the claim, or (b) USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless vfxmagia from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Input Content, your use of the output, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

Consumed credits are never refunded. If we terminate or suspend your account for cause (including breach of these Terms), any unused prepaid credits are forfeited. If you close your account voluntarily, or if we terminate without cause, any unused prepaid credits are forfeited except where a refund is required by applicable law.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

vfxmagia is an independent project operated by an individual (the “Operator”, “we”, “us”). These Terms are governed by the laws of the United States and the state in which the Operator resides, without regard to conflict-of-laws principles. The exclusive venue for any dispute is the state and federal courts of that location, and you consent to personal jurisdiction there.

Informal resolution. Before filing a claim, you agree to first contact us at contact@vfxmagia.com and attempt to resolve the dispute informally for at least 30 days after written notice describing the dispute.

Limitation period. Any claim relating to the Service must be brought within one (1) year after it arises, or it is permanently barred, except where applicable law prohibits such a limitation.

• Entire agreement. These Terms, together with the Privacy Policy and the pricing page, are the entire agreement between you and vfxmagia and supersede any prior understandings on their subject matter.
• Severability. If any provision is held unenforceable, it is severed or limited to the minimum extent necessary, and the remaining provisions stay in full force.
• Assignment. We may assign these Terms, including in connection with a merger, acquisition, or sale of assets. You may not assign your rights or obligations without our prior written consent.
• No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
• Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including outages of any third-party AI generation provider or other infrastructure provider.
